What this license covers
Active Spiraria subscribers and custom-project clients receive a commercial license to play the supplied original music publicly within their venue(s), for the duration of their plan or as specified in their project agreement. TODO: finalise exact grant, territory and term with counsel.
Original & directly licensed
Spiraria music is original and licensed directly to you. It is not registered with collecting societies, so no separate society tariff is due on our music. You remain responsible for any licenses relating to music from other sources you may play.
Restrictions
The license does not permit redistribution, resale, sublicensing, synchronisation in third-party productions, or use outside the venues covered by your plan. TODO: confirm.
If a collecting society ever asks
The music in the Spiraria catalogue is owned by Spiraria and licensed directly to you — it is not registered with PRS/PPL, ASCAP/BMI/SESAC, SIAE/SCF or any other collecting society, so there is no separate tariff owed on it. If an inspector or collecting-society representative ever questions the music playing in your venue, your account includes:
- A dated license confirmation naming your venue and active plan.
- A full track list of the catalogue covered by that plan.
- A direct contact at Spiraria who can confirm your license on request.
Keep this documentation on file at your venue. If you're ever asked to prove your music is licensed, showing this — or having us confirm it directly — is normally all that's required. Contact us straight away at gabrielerauzino@gmail.com if you need anything for an active inspection.
TODO: have a lawyer turn this into a proper warranty/indemnity clause, define exactly what documentation is issued per subscriber, and confirm the process for time-sensitive requests during an active inspection.
